The lessee may under some circumstances amortize the key money paid to the lessor


The key money is a sum which the lessee pays the lessor upon taking possession of premises for commercial, industrial, or handicraft uses. In his article “Il n’existe pas d’interdiction de principe d’amortir le droit d’entrée versé au bailleur” (Expression Acheter-Louer.Fr, n° 51 juillet/août 2016), Réginald Legenre, Of Counsel, analyzes the recent ruling of the Conseil d’État (France's highest administrative court) setting out the conditions under which the lessee may amortize the key money.
